A commercial lease is a legally binding contract, which will have an end date (termed lease expiry) which is referenced in the lease. If your lease is not about to end, does you lease contain a tenant break clause, allowing you to exit the lease earlier. Break clauses within commercial leases are normally subject to service of notices and are subject to conditions, which are outlined within the lease. Before serving a break notice, take professional advice.
Depending on the original lease terms agreed, you may also be able to assign your lease or sublet (underlet). Although this will involve marketing the property and finding a third party.
Alternatively, if you have exhausted all these options, the landlord could be approached to negotiate a lease surrender, which has the effect of bringing the lease to an end early.
This will depend on how the lease was originally negotiated and what options you have available to you. The lease can be brought to an end on lease expiry, by a break clause or by agreeing a lease surrender with your landlord.
If a commercial lease is “Contracted Out” the lease ends on the day of the lease expiry. No notice is required.
If the lease is protected by the Security of tenure provisions of the Landlord and Tenant Act 1954 Part II, the landlord will serve a section 25 notice, giving his grounds for objection and 6-12 month’s notice is required to bring a tenancy to an end.
This is subject to negotiation between a landlord and tenant (or their representatives). The cost will depend on how long the lease has remaining, the annual rent and other costs and will be dependent on the negotiating strengths of the parties. For example, does the landlord want the property back?
